Our consultants are specialists in maritime law and the United Nations Convention on the Law of the Sea relating to submarine cables and their impact with other seabed users.
Pelagian's consultants investigate and identify all the necessary permits to fulfil the requirements of local and national government and industry. These include operators licenses; permissions; authorisations; consents; rights; approvals; concurrences; letters of no-objection; crossing agreements and notifications.
Pelagian are experts in permit acquisition through the following process levels. Proprietary PermitsThose relating to the right of land or seabed ownership, occupancy or use. This includes easements, rights-of-way, wayleaves, and submerged land leases. Regulatory PermitsThose relating to the authority of a Government to limit certain activities on private and publicly owned lands. This includes excavation permits, environmental impact assessments, foreign work visas, importation licences and marine operational permits for survey and installation vessels.
Terrestrial, Marine, and Seabed User Crossing Agreements
Those agreements that may be required where the cable crosses other terrestrial and marine seabed users with established rights based on property ownership or historical use. Examples include agreements with indigenous populations, non government organisations (NGO's), subsistence and commercial fishing entities, pipeline and cable owners, military exercise and training areas and hydrocarbon / mineral concession block owners.
Pelagian has a long track record of providing permitting support to the major telecommunications customers and survey companies; generating permit feasibility reports for desk top studies; facilitating permit applications and compiling tracking documents for survey and installation operations. In addition our consultants are experts at crossing agreement negotiation and documentation.
